RULE OF LAW - Part II

Three middle-aged wealthy men who were influenced by Great Britain wrote The Federal Papers describing the CORE VALUES of the American People, because these aristocrats did not believe that the common man did not have the ability to articulate something so intellectually important.  And, while that might be true, it is highly arrogant, egotistical, with an air of astronomical self-importance...

So, what are are American CORE VALUES?

  • Highly Religious
  • Hard Working
  • Equality
  • Family Oriented
  • Community Oriented
  • High Moral & Integrity
  • Honesty & Fair Play
UNFORTUNATELY, these core values only pertained to the caucasian race that most immigrated from Europe.  Very few if any extend out into the black communities or other minorities.  And, most importantly, 80% of Americans no longer believe in any of these as their CORE VALUES...

Young American was comprised of Aristocrats who settled the north and provided us with our manufacturing base while the south was settled unorthodox aristocrats who relied on immigrants that had been released from European prisons.  This formed the North/South hatred that is still in existence today.

Since 1776, America has changed dramatically not only in its populations of immigrants but in how each ethnic group perseceives and tolerates other ethnic groups.

Blacks have made the overt decision to challenge America's RULE OF LAW by not following it as much as they are trying to destroy it...  Blacks have seen first hand that America's RULE OF LAW does not pertain to everyone equally and fairly which has caused much negative reflections in their various ethnic bands spread throughout the United States.

TODAY, our RULE OF LAW is shot to hell and for all intense and purposes does not exist at all except in the minds of our law makers on Capital Hill who continue to perceive that they are making laws that will benefit a majority of the people...  when in reality their bills and laws are highly partisan....  like this current movement to completely halt the use of petroleum crude oil...  

Their idiocy extends to closing down pipelines in the US/Canada that made us energy independent so that if we needed any additional oil, we would be forced to buy that our from our enemies making them wealthier than they were before...
NO RULE OF LAW HERE...

We have millions of immigrants crossing into our country along the southern border making each one that enters our RULE OF LAW country doing so by breaking the law...

How can anyone say that we have RULE OF LAW in the USA when illegal immigration is out of control?
NO RULE OF LAW HERE...

The Supreme Court of the US interprets the RULE OF LAW that the CONGRESS passes to determine if these laws align themselves with the guidelines in the US Constitution or not.  If these laws do not, they are deemed unconstitutional and can no longer be enforce.

The US Constitution makes it an illegal act for people to protest outside the homes of the Supreme Court Justices in an effort of intimidation to persuade them to vote a different way.

Today, there are hundreds of civil protestors in front of a few of the home of Supreme Court Justices trying to persuade them not to overturn Roe V Wade....

This is blatantly against the law and the current Department of Justice refuses to enforce the law and disperse the crowd.

RULE OF LAW - Part I

More than 200 years ago, Alexander Hamilton, James Madison, and John Jay published a series of essays promoting the ratification of the United States Constitution now known as Federalist Papers. In explaining the need for an independent judiciary, Alexander Hamilton noted in The Federalist # 78 that the federal courts "were designed to be an intermediate body between the people and their legislature" in order to ensure that the people's representatives acted only within the authority given to Congress under the Constitution.

The U.S. Constitution is the nation's fundamental law. It codifies the core values of the people. Courts have the responsibility to interpret the Constitution's meaning, as well as the meaning of any laws passed by Congress. The Federalist # 78 states further that, if any law passed by Congress conflicts with the Constitution, "the Constitution ought to be preferred to the statute, the intention of the people to the intention of their agents."

"Nor does this conclusion by any means suppose a superiority of the judicial to the legislative power. It only supposed that the power of the people is superior to both; and that where the will of the legislature, declared in its statutes, stands in opposition to that of the people, declared in the Constitution, the judges ought to be governed by the latter rather than the former. They ought to regulate their decisions by the fundamental laws, rather than by those which are not fundamental."

The American democratic system is not always based upon simple majority rule. There are certain principles that are so important to the nation that the majority has agreed not to interfere in these areas. For instance, the Bill of Rights was passed because concepts such as freedom of religion, speech, equal treatment, and due process of law were deemed so important that, barring a Constitutional Amendment, not even a majority should be allowed to change them.

Rule of law is a principle under which all persons, institutions, and entities are accountable to laws that are:
  • Publicly promulgated
  • Equally enforced
  • Independently adjudicated
  • And consistent with international human rights principles.

The courts play an integral role in maintaining the rule of law, particularly when they hear the grievances voiced by minority groups or by those who may hold minority opinions. Equality before the law is such an essential part of the American system of government that, when a majority, whether acting intentionally or unintentionally, infringes upon the rights of a minority, the Court may see fit to hear both sides of the controversy in court.

60% Versus 12%

 According to the most recent census data, the percentage of whites in the US population is 60% whereas the percentage of blacks in the US population is 12%...  In other words, there are FIVE times more whites in America than there are blacks.

What does that mean?

ONE out of every FIVE Americans are black...  and yet, minority group wants to control everything that is going on in this county from law enforcement to politics to Hollywood to Professional Athletics to Musicians and Artists to those CEO's who are managing our companies.

Blacks want to receive preferential treatment because they were brought to this country in 1619 against their will...  that is over 400 years ago...  and 157 years before we gained our independence from Great Britain; however, just because the whites gained their independence does not mean that the blacks actually gained their independence as well...  NO...  it took another 87 years for the blacks to actually receive their independence.

WHY...  did it take so long?

OUR FOUNDING FATHERS (All of them) WERE RACISTS...  there is no doubts about that fact...  now, here is the interesting question:

DID PRESIDENT LINCOLN FREE THE SLAVES TO INCREASE THE SIZE OF HIS ARMY AGAINST THE SOUTH OR DID HE FREE THE SLAVES BECAUSE HE WAS AGAINST SLAVERY?

Lincoln's wife owned slaves...

We, that is to say Americans, treated the Native Americans almost as bad as we treated the blacks...  and, to compensate them for our bad treatment, we allowed them to operate GAMBLING CASINOS on their territory only...  but, they get all the revenues.

That was really white of us to do that.

Interestingly, the US Constitution that governs our country was actually written for the WHITES not the BLACKS even though they were included by an amendment...  but, in the minds of most blacks that did not correct the injustice; however, what will correct the injustice will be that REALITY where ALL WHITENESS is removed from the way Americans live...   that is to say that the 60% should bend over backwards to pacify the 12% as a form of compensation.

What does that mean exactly?

That means BLACKS no longer want WHITES to be White...  because if WHITES continue to be White, then that is racism and racism negatively impacts 12% of all Americans.

It means that laws should be rewritten to favor blacks over whites in the courts of law.

It means that Blacks should get preferential treatment at college and university over the WHITES.

It means that Blacks should be hired before Whites are hired even if they are less qualified because it was the Whites that manipulated the system that forced them to be less qualified in the first place.

However, I don't think Blacks want to be first in line in the MILITARY since being first there might result in a loss of life...  but that is just a personal opinion and not based upon any solid evidence or facts.

I am also not sure how this relates to selling illegal drugs either because most of the dope dealers are black and most of the dope users are white...  and, I doubt very seriously if they really want to change places.

Because blacks were slaves they should be given every thing they want or they will revolt in the streets, burn, and loot to show their disappointment.  And...  since the law enforcement is systemically racist, then we should do away with the police force...  or at least have NO WHITE LAW ENFORCEMENT OFFICERS so if blacks are killed by police, they will have been killed by black police.

IT IS TIME THAT WHITES LISTEN AND STOP BEING WHITE ONCE AND FOR ALL...  white should not even be a color or for that matter a word in the dictionary.

Interpreting Our US Constitution

                                          
In the context of United States law, originalism is a concept regarding the interpretation of the Constitution that asserts that all statements in the constitution must be interpreted based on the original understanding "at the time it was adopted".


Textualism is a mode of interpretation that focuses on the plain meaning of the text of a legal document. Textualism usually emphasizes how the terms in the Constitution would be understood by people at the time they were ratified, as well as the context in which those terms appear.

US CONSTITUTIONAL FACTS:
  1. James Madison wrote the Constitution in 1787
  2. Of the 55 Convention delegates, about 25 owned slaves. Many of the framers harbored moral qualms about slavery. Some, including Benjamin Franklin (a former slave-owner) and Alexander Hamilton (who was born in a slave colony in the British West Indies) became members of antislavery societies.
  3. The Northern delegates and others opposed to slavery wanted to count only free persons, including free blacks in the North and South. ... Minimizing the percentage of the slave population counted for apportionment reduced the political power of slaveholding states.
  4. Of our FOUNDING FATHERS:  Samuel Adams, John Adams, & Thomas Paine NEVER OWNED SLAVES
  5. Slave/Slavery was only mentioned indirectly in the US CONSTITUTION
  6. THE US CONSTITUTION WAS RATIFIED ON SEPTEMBER 17 1787...
  7. When did the US get independence from Great Britain?  JULY 4, 1776...
  8. It took 11 years for ALL THE STATES to RATIFY the US CONSTITUTION
  9. All US SLAVES were freed January 1, 1863
  10. In 1870, the 15th Amendment was ratified to prohibit states from denying a male citizen the right to vote based on “race, color or previous condition of servitude." "Black suffrage" in the United States in the aftermath of the American Civil War explicitly referred to the voting rights of black men only.
  11.  In 1920, the 19th Amendment to the US Constitution gave WOMEN the right to vote


QUESTIONS:   

  1. Is it FAIR to use the concepts of textualism and and originalism when interpreting the US CONSTITUTION since our BLACK population was not given RIGHTS until 75+ years later? 
  2. Is it fair to use the concepts of textualism and originalism when interpreting the US CONSTITUTION since it was UNDERSTOOD AT THE TIME OF THE WRITTING of the US Constitution that half of the delegate to the Constitutional Convention did not own slaves and were struggling with the slavery issue?
  3. Is it fair to use the concepts of textualism and originalism when interpreting the US CONSTITUTION when it comes to understanding how our Founding Father felt towards women when it comes to interpreting what rights do women actually have under the US Constitution?
  4. Is it fair to use the concepts of textualism and originalism when interpreting the US CONSTITUTION when it come time to decide whether or not we should as nation whether or not we should regulate firearms, especially since our Founding Father had just formed a new country and had not yet built up a military or a National Guard?


Personal Comments:
It simply does not seem fair or logical for our Court System to use how our Founding Fathers were thinking in their minds and how the words they used were interpreted back in 1787 to decide ALL ISSUES coming before the courts because there have been substantial changes like gun violence, abortion, discrimination, and equal rights with which our FOUNDING FATHERS never had to deal with at the time the Constitution was written, therefore their mental thoughts and word usages seems rather pointless and meaningless in today's world.

In What Do I Believe?

Spiritual/Religious
  1. that there is a Creator of the Universe
  2. that creation of the Universe was of Intelligent Design
  3. that there are multiple dimension in our universe
  4. that there are other intelligent forms of life in our universe
  5. that all beliefs were given to us by our Creator
  6. that mankind will ultimately destroy itself
  7. that wealth creation is not the intended purpose of life

Governmental
  1. that there must be some form of regulatory government
    1. to protect and negotiate
    2. to educate
    3. to feed, clothe, and house
    4. to cure when sick
    5. to care for when old
  2. that governmental power be divided into thirds
    1. make the laws
    2. enforce the laws
    3. judge and interpret the laws
  3. that there must be a rule of law
  4. that the population cannot properly govern itself
  5. that the government must be small and well defined
  6. that the people have well defined rights and guarantees
  7. that debt to provide services should be avoided or made illegal
  8. that wars should be fought to protect homeland only
  9. that nations have a fundamental right to conquer 
  10. that all individuals will never be financially equal

As far as the US Constitution and Bill of Rights is concerned:
  1. Our government is not responsible for our happiness
  2. Speech should never be censored
  3. Beliefs should never be denied or used against an individual or group
  4. Individuals have a right to defend themselves
  5. Females have a right to do whatever they want to regarding their bodies
  6. Males and Females will never be equal physically, mentally, or in their skills and abilities
  7. Ethnicities will never be equal physically, mentally, or in their skills and abilities
  8. Manipulation of the people should be prevented
